These Terms of Use ("Terms") govern your access to and use of the website located at smconstruction.com and any related subdomains or subpages (the "Site"), operated by Steve Melton Construction ("SMC," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms apply to your use of the Site only. They do not govern any construction services, remodeling work, custom home builds, or any other services SMC provides. Those services are governed by a separate written agreement executed between SMC and the client for each project. Nothing on the Site constitutes an offer to enter into a construction contract, and no communication through the Site creates any binding agreement for services.
2. Eligibility
You must be at least 18 years old to use the Site. By using the Site, you represent that you are 18 or older and that you have the legal capacity to enter into a binding agreement with SMC.
3. Description of the Site
The Site provides general information about SMC, our services, our past projects, and how to contact us. It may include:
Information about custom home building, remodeling, and related services
Portfolio images of completed and in-progress projects
Team member profiles
Blog posts and educational content
Contact forms, quote request forms, and other communication tools
Links to third-party sites, tools, or platforms (including client portals such as Buildertrend, if applicable)

5. No Guarantees on Estimates or Pricing
Any general pricing information, cost ranges, project timelines, or "starting at" figures shown on the Site are informational only and are not binding. Actual project pricing and timelines depend on scope, materials, site conditions, permits, and other factors specific to each project. SMC provides binding pricing only in a written estimate or contract signed by an authorized SMC representative.

When using the Site, you agree not to:

Interfere with, disrupt, probe, or attempt to gain unauthorized access to any part of the Site, its servers, or any connected network

The name "Steve Melton Construction," the SMC logo, and any related brand marks are trademarks of SMC and may not be used without our prior written permission.

10. Photographs and Testimonials
Project photographs displayed on the Site depict real projects completed by SMC. Photos may be edited for lighting, cropping, or clarity but are not staged or misrepresented. Homeowner names, project details, and locations are used only with the homeowner's permission.
Testimonials and reviews shown on the Site are the honest opinions of the individuals who provided them. Individual experiences may vary. Testimonials do not constitute a guarantee of any specific result, timeline, or outcome for any other project.
11. Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, SMC disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted or error-free operation.
SMC does not warrant that the Site will be free from viruses, malware, or other harmful components, that defects will be corrected, or that the Site or the servers hosting it will meet your requirements or be free from interruption.
Nothing in this section limits or excludes any warranty, right, or remedy that cannot be limited or excluded under applicable law.
12. Limitation of Liability
To the fullest extent permitted by law, SMC and its owners, officers, employees, agents, subcontractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or in connection with your access to or use of the Site, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if SMC has been advised of the possibility of such damages.
In no event will SMC's total aggregate liability arising out of or in connection with the Site exceed one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above limitations may not apply to you. To the maximum extent permitted by law, the limitations in this section will apply.
13. Indemnification
You agree to defend, indemnify, and hold harmless SMC and its owners, officers, employees, agents, subcontractors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your violation of these Terms
Your violation of any right of another person or entity, including any intellectual property or privacy right

SMC may suspend or terminate your access to the Site at any time, for any reason or no reason, without notice. Sections 7 through 13 and Section 17 will survive any termination.
16. Governing Law and Venue
These Terms and any dispute arising out of or relating to these Terms or your use of the Site are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.
17. Miscellaneous
Entire Agreement. These Terms constitute the entire agreement between you and SMC regarding your use of the Site and supersede any prior agreements between you and SMC on the subject.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
No Waiver. SMC's failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or any rights or obligations under them without SMC's prior written consent. SMC may assign these Terms without restriction.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
